InfoPogo provides software applications and related services, including but not limited to mobile applications such as Meridian / JetProp Torque and Millibars / Inches Calculator, and the website at www.infopogo.com. The Service is offered for informational and educational use. We may modify, suspend, or discontinue any part of the Service at any time with or without notice.

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

Some of our applications, including Meridian / JetProp Torque, provide calculations or reference information related to aircraft performance. Such information is for educational and planning purposes only. It is not a substitute for your current Aircraft Flight Manual (AFM), Pilot Operating Handbook (POH), or other approved manufacturer or regulatory documentation. Always use your aircraft’s current AFM, POH, and applicable regulations when operating an aircraft. InfoPogo is not responsible for any errors in calculations or for any decisions made in reliance on the Service. Use of the Service does not constitute legal, operational, or professional advice.

The Service, including its design, text, graphics, software, and other content (excluding user content and third-party materials), is owned by InfoPogo or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or branding without our prior written consent. You retain any rights you have in content you submit; by submitting content, you grant us a non-exclusive, royalty-free license to use it in connection with the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INFOPOGO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER. We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service.
13. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms constitute the entire agreement between you and InfoPogo regarding the Service and supersede any prior agreements.
